        <![CDATA[Not everyone in a Rhode Island divorce needs a lawyer for everything in the divorce.<div><br /></div><div>A little help filing the divorce packet to make sure everything is covered may be just what the coach ordered.</div><div><br /></div><div>Or perhaps you need the legal advice to know your rights and what to expect in the whole process both legally and procedurally throughout the divorce. &nbsp;The divorce coach is on the job for you.</div><div><br /></div><div>Maybe you aren't even concerned about these two things and you want help with what to say at the hearing so that everything goes smoothly at your nominal divorce hearing. &nbsp;Once again, a Rhode Island divorce coach is just what you need to get the job done.</div><div><br /></div><div>Take this example:</div><div><br /></div><div>John was able to handle the filing paperwork without too much difficulty and he worked out an agreement with his wife but John has looked at the questions provided by the court and some of them don't seem to apply to his situation. &nbsp;John wants things to be over and done with and</div><div>needs to get back to work if he can right after the hearing. &nbsp;John isn't really sure about what to say or how to conduct the hearing.</div><div><br /></div><div>John has heard that the judge he will be in front of will not help him in the slightest when his hearing comes up so he wants to be prepared. &nbsp;John calls a few divorce lawyers but they will not help him simply for the divorce hearing itself. &nbsp;The lawyers want $1,500.00 to get involved and encourage John to get a continuance. &nbsp;John is frustrated.</div><div><br /></div><div>John hears about my divorce coaching and gives me a call. "><font class="Apple-style-span" style="font-size: 1.25em; "><br /></font></font></div><div><font class="Apple-style-span" style="font-size: 1.25em; "><font class="Apple-style-span" style="font-size: 1.25em; ">However, Rhode Island family court judges are guided by statutes and cases decided by our Rhode Island Supreme Court when determining which assets are "pre-marital."</font></font></div><div><font class="Apple-style-span" style="font-size: 1.25em; "><font class="Apple-style-span" style="font-size: 1.25em; "><br /></font></font></div><div><font class="Apple-style-span" style="font-size: 1.25em; "><font class="Apple-style-span" style="font-size: 1.25em; ">Generally, pre-marital assets are outside the power of the Rhode Island Family Court to divide, distribute, or control in a Rhode Island divorce proceeding. &nbsp;</font></font></div><div><font class="Apple-style-span" style="font-size: 1.25em; "><font class="Apple-style-span" style="font-size: 1.25em; "><br /></font></font></div><div><font class="Apple-style-span" style="font-size: 1.25em; "><font class="Apple-style-span" style="font-size: 1.25em; ">However, assets only fall outside the power of the Rhode Island Family Court </font></font><b><u><font class="Apple-style-span" style="font-size: 1.25em; "><font class="Apple-style-span" style="font-size: 1.25em; ">after</font></font></u><font class="Apple-style-span" style="font-size: 1.25em; "><font class="Apple-style-span" style="font-size: 1.25em; "> </font></font></b><font class="Apple-style-span" style="font-size: 1.25em; "><font class="Apple-style-span" style="font-size: 1.25em; ">the judge assigned to your divorce determines that an asset is, in fact, a pre-marital asset. &nbsp;Until that time, an asset is part of your divorce and falls within the power of the court and the laws and orders regarding divorces.</font></font></div><div><font class="Apple-style-span" style="font-size: 1.25em; "><font class="Apple-style-span" style="font-size: 1.25em; "><br /></font></font></div><div><font class="Apple-style-span" style="font-size: 1.25em; "><font class="Apple-style-span" style="font-size: 1.25em; ">A pre-marital asset is an asset owned by only one spouse prior to the marriage,&nbsp;</font></font><b><u><font class="Apple-style-span" style="font-size: 1.25em; "><font class="Apple-style-span" style="font-size: 1.25em; ">and</font></font></u></b><font class="Apple-style-span" style="font-size: 1.25em; "><font class="Apple-style-span" style="font-size: 1.25em; ">&nbsp;remains completely separate from the other spouse during the marriage. &nbsp;This includes, its ownership, its storage, its replacement, its repair, its enhancement, any insurance on the asset, and any other aspect of the marital relationship and/or income.&nbsp;</font></font></div><div><font class="Apple-style-span" style="font-size: 1.25em; "><font class="Apple-style-span" style="font-size: 1.25em; "><br /></font></font></div><div><font class="Apple-style-span" style="font-size: 1.25em; "><font class="Apple-style-span" style="font-size: 1.25em; ">If during the marriage an asset was treated or preserved in any way, legally or practically, which indicates that it was owned by both spouses, then the asset's </font></font><i><b><font class="Apple-style-span" style="font-size: 1.25em; "><font class="Apple-style-span" style="font-size: 1.25em; ">character</font></font></b></i><font class="Apple-style-span" style="font-size: 1.25em; "><font class="Apple-style-span" style="font-size: 1.25em; ">&nbsp;may change from pre-marital to marital.</font></font></div><div><font class="Apple-style-span" style="font-size: 1.25em; "><font class="Apple-style-span" style="font-size: 1.25em; "><br /></font></font></div><div><font class="Apple-style-span" style="font-size: 1.25em; "><font class="Apple-style-span" style="font-size: 1.25em; ">Keep in mind that any </font></font><b><font class="Apple-style-span" style="font-size: 1.25em; "><font class="Apple-style-span" style="font-size: 1.25em; ">change in value</font></font></b><font class="Apple-style-span" style="font-size: 1.25em; "><font class="Apple-style-span" style="font-size: 1.25em; "> of a "pre-marital asset" during the marriage may be treated as a marital asset. &nbsp;For example, Deborah buys a diamond ring at an estate sale while she is single. &nbsp;Deborah marries Francis. &nbsp;During Deborah's twenty-five (25) year marriage to Francis, the diamond ring appreciates in value by 30%. &nbsp;Even though the ring may be a pre-marital asset and typically not within the power of the Rhode Island Family Court Judge to divide and distribute, the 30% appreciation of the ring during the marriage may be considered a marital asset if the Judge determines it to be so because it occurred while Deborah and Francis were married.</font></font></div><div><br /></div><div><br /></div>

        <![CDATA[As a Rhode Island lawyer focusing my practice mostly on divorce coaching these days I look back upon a man who said something to me privately decades ago that perplexed me. &nbsp;This man had been practicing in another state for some 40+ years.<div><br /></div><div>This man was about as true, honorable and generous a gentleman as I have ever met. &nbsp;He embodied everything that I saw in a good lawyer. &nbsp;He truly cared about his clients. &nbsp;He fought for each one of them. &nbsp;Yet he did so within the bounds of the law, within the bounds of his professional ethical code, and with a high degree of morality such as I have never seen before. &nbsp;The lawyer&nbsp;knew that I admired him and had great respect for him as both a person and as a lawyer. &nbsp;</div><div><br /></div><div>One extremely hot Tuesday afternoon this rather portly lawyer returned to his office after losing a &nbsp;district court hearing. &nbsp;He plopped himself down in the chair at the opposite end of the short conference room table I was sitting at in the office law library. &nbsp;His secretary nervously brought him a lemonade and napkin then quickly skirted out of the room. &nbsp;There was silence. &nbsp;It seemed to go on forever. &nbsp;Finally, I said, "I'm considering becoming a lawyer."</div><div><br /></div><div>It lasted perhaps two seconds but it seemed like an eternity. &nbsp;The lawyer lifted his &nbsp;partially balding forehead, wiped his brow with the napkin then grabbed a nearby law book and flung it across his small law library. &nbsp;The book smashed against a row of New Hampshire Statutes Annotated. &nbsp;I heard the spine of the hardcover book tear slightly as it fell to the floor.</div><div><br /></div><div>It was one of the first times I had ever seen this man so angry and upset.</div><div><br /></div><div>I was quiet. &nbsp;Perhaps my timing was off. &nbsp;This time I kept my big mouth shut and waited until the lawyer spoke. &nbsp;This is what he said.</div><div><br /></div><blockquote class="webkit-indent-blockquote" style="margin: 0 0 0 40px; border: none; padding: 0px;"><div><b><i>Lawyer: <span class="Apple-style-span" style="font-weight: normal;">&nbsp;[Very Loudly though not Shouting] </span>"I HATE LAWYERS!</i></b>&nbsp;</div><div><br /></div></blockquote>This time the pause was endless and it seemed very clear the lawyer wasn't going to say anything else. &nbsp;So, I took a chance. &nbsp;I was just too puzzled not to speak.<div><br /></div><blockquote class="webkit-indent-blockquote" style="margin: 0 0 0 40px; border: none; padding: 0px;"><div><b>Chris: &nbsp;"I don't understand. &nbsp;You are a lawyer."</b></div></blockquote><div><div>&nbsp;&nbsp; &nbsp;</div></div><div>He was quiet for another period of time. &nbsp;I took a chance and asked my question.</div><div><br /></div><blockquote class="webkit-indent-blockquote" style="margin: 0 0 0 40px; border: none; padding: 0px;"><div><b>Chris: &nbsp;"How can you hate lawyers when you are one? &nbsp;I don't get it."</b></div><div><br /></div></blockquote>He waited quite awhile before speaking. &nbsp; I was thankful that there wasn't another hardcover book within the lawyer's reach.<div><br /></div><blockquote class="webkit-indent-blockquote" style="margin: 0 0 0 40px; border: none; padding: 0px;"><div><b>Lawyer: &nbsp;</b><i>[ A bit calmer . . &nbsp;]</i><b> &nbsp; Also, can she refuse to let you have ANY rates to have your children to see tehm if you are paying child support?</span></div><div><font class="Apple-style-span" color="#000000" face="Arial, Helvetica, sans-serif"><br /></font></div><div><font class="Apple-style-span" color="#000000"><font class="Apple-style-span" style="font-size: 1.25em; "><font class="Apple-style-span" style="font-size: 1.25em; "><b>Answer:</b></font></font></font></div><div><font class="Apple-style-span" color="#000000" size="6"><span class="Apple-style-span" style="font-size: 20px;"><b><br /></b></span></font></div><div><font class="Apple-style-span" color="#000000" size="6"><span class="Apple-style-span" style="font-size: 20px;"><b><span class="Apple-style-span" style="font-size: 14px; font-weight: normal; "><font class="Apple-style-span" style="font-size: 1.25em; ">Part of your question is somewhat confusing so I will try to be clear based upon what I believe you are asking. &nbsp;You should be aware that paying for a health insurance plan is not child support.</font></span><span class="Apple-style-span" style="font-family: Arial, Helvetica, sans-serif; font-size: 14px; font-weight: normal; ">&nbsp;</span></b></span></font></div><div><font class="Apple-style-span" color="#000000" face="Arial, Helvetica, sans-serif"><br /></font></div><div><font class="Apple-style-span" color="#000000" size="6"><span class="Apple-style-span" style="font-size: 20px;"><b><span class="Apple-style-span" style="font-size: 14px; font-weight: normal; "><font class="Apple-style-span" style="font-size: 1.25em; ">If you go to trial and the court orders you to pay for a family health insurance plan that covers your ex-spouse then it is most likely to be pursuant to the terms of the Rhode Island Insurance Continuation Act which prohibits the insurance carrier you are with from removing your ex-spouse from the health insurance plan simply because you are no longer married.</font></span><span class="Apple-style-span" style="font-family: Arial, Helvetica, sans-serif; font-size: 14px; font-weight: normal; ">&nbsp;</span></b></span></font></div><div><font class="Apple-style-span" color="#000000" face="Arial, Helvetica, sans-serif"><br /></font></div><div><font class="Apple-style-span" color="#000000" size="6"><span class="Apple-style-span" style="font-size: 20px;"><b><span class="Apple-style-span" style="font-size: 14px; font-weight: normal; "><font class="Apple-style-span" style="font-size: 1.25em; ">There are exceptions but there is not enough time or space to address them here. However, unless you adopted your spouse's child, if that child is not your natural (i.e. biological child) then you have an obligation to notify your health insurance carrier about that child so the insurance carrier can determine if that child qualifies under your Family Health Plan. . . there is a good chance that the child may not qualify.</font></span><span class="Apple-style-span" style="font-family: Arial, Helvetica, sans-serif; font-size: 14px; font-weight: normal; ">&nbsp;</span></b></span></font></div><div><font class="Apple-style-span" color="#000000" face="Arial, Helvetica, sans-serif"><br /></font></div><div><font class="Apple-style-span" color="#000000" size="6"><span class="Apple-style-span" style="font-size: 20px;"><b><span class="Apple-style-span" style="font-size: 14px; font-weight: normal; "><font class="Apple-style-span" style="font-size: 1.25em; ">If you do not notify the insurance carrier and you keep the child on if the insurance carrier had a right to know about her status due to your divorce, then you may well be guilty of criminal insurance fraud. If you have been providing the plan and paying for it on your own for your ex-spouse and your children during your marriage, then you may be ordered by the court to continue providing that coverage especially regarding your children.</font></span><span class="Apple-style-span" style="font-family: Arial, Helvetica, sans-serif; font-size: 14px; font-weight: normal; ">&nbsp;</span></b></span></font></div><div><font class="Apple-style-span" color="#000000" face="Arial, Helvetica, sans-serif"><br /></font></div><div><font class="Apple-style-span" color="#000000" size="6"><span class="Apple-style-span" style="font-size: 20px;"><b><span class="Apple-style-span" style="font-size: 14px; font-weight: normal; "><font class="Apple-style-span" style="font-size: 1.25em; ">The court could require you to continue providing insurance coverage for your biological or legally adopted children could be indefinite.         <![CDATA[I would like to apologize to the parties mentioned (especially my client) regarding a recent blog article I wrote relating to my interest in R.I. General Laws 15-5-2(8).<div><br /></div><div>Although factual information in the article was a matter of public record and my questions were for the purpose of educational and cognitive discourse about the rarely used RI Gen Laws 15-5-2(8), the article caused issues.&nbsp;</div><div><br /></div><div>&nbsp;It seems too many people assume even via hypothetical questions that facts have been proven and warrant accusing others of things recklessly.  This is NOT the case.&nbsp; 

</div><div><br /></div><div>Clearly the internet has too great an influence on the minds of people.  There is a great difference between public record contained in a court's paper file and public record with hypothetical questions that are posted on the internet.&nbsp;</div><div><br /></div><div>For the record, the woman identified in that article did not approve of, review, edit, read, nor even know about the existence of my article referencing Rhode Island General Laws 15-5-2(8) until after it was published. <p><font class="Apple-style-span" size="5"><span class="Apple-style-span" style="font-size: 17px; line-height: 20px;"><br /></span></font></p><p><span class="Apple-style-span" style="font-size: 17px; line-height: 20px; ">This hypothetical and its questions demonstrate how factual changes and/or allegations by a party might affect a RI Divorce proceeding for the parties, their minor children, the attorneys involved, and what the Rhode Island Family Court Judges sometimes have to consider in cases that diverge from the typical "irreconcilable differences" divorce cases.</span></p>

<p><font class="Apple-style-span" size="5"><span class="Apple-style-span" style="font-size: 17px; line-height: 20px;"><b><br /></b></span></font></p><p><font size="5"><span style="font-size: 17px; line-height: 20px;"><strong>* * THE SECTION (8) HYPOTHETICAL * *</strong></span></font></p>

<p><font class="Apple-style-span" color="#000000" size="5"><span class="Apple-style-span" style="font-size: 17px;"><br /></span></font></p><p><span style="color: #0000bf; "><span style="color: #000000; font-size: 17px; ">In this hypothetical case, the husband is the primary wage earner of the family. &nbsp; The parties have been married for eight years and have a couple children. Imagine that the the wife discovers that the husband was engaging in relationships with men and possibly other women.</span></span></p>

<p><font class="Apple-style-span" size="5"><span class="Apple-style-span" style="font-size: 17px;"><br /></span></font></p><p><span style="font-size: 17px; ">After the wife discovers this about the husband she files for divorce under RI General Laws 15-5-2(8).</span></p><p><font class="Apple-style-span" size="5"><span class="Apple-style-span" style="font-size: 17px;"><br /></span></font></p>

<p><span style="font-size: 17px; ">It should be noted that Rhode Island General Laws 15-5-2(8) is a grounds for divorce that is very seldom used in Rhode Island Family Court.</span></p><p><font class="Apple-style-span" size="5"><span class="Apple-style-span" style="font-size: 17px;"><br /></span></font></p><p><span style="font-size: 17px; "><span class="Apple-style-span" style="font-size: 14px; "><span style="font-size: 17px; ">Section (8) states that a RI divorce may be granted for</span><span style="color: #000000; line-height: 14px; "><span style="font-size: 15px; ">&nbsp;<span style="font-size: 17px; ">gross misbehavior and wickedness, in either of the parties, repugnant to and in violation of the marriage covenant.</span></span></span></span></span></p><p><span style="color: #000000; line-height: 14px; "><span style="font-size: 15px; "></span></span></p><p><font class="Apple-style-span" color="#000000" size="5"><span class="Apple-style-span" style="font-size: 17px; line-height: 14px;"><br /></span></font></p>

<p><span style="font-size: 17px; ">Hypothetically, a divorce case in Rhode Island such as this is one of considerable interest since it raises more questions than it actually answers for the parties, the lawyers and particularly for the Rhode Island Family Court.</span></p>

<p><span style="font-size: 17px; ">Assume purely for this hypothetical that the husband may be a person of bi-sexual and/or homosexual orientation but&nbsp;has been unable to come to terms with his own sexuality. &nbsp;What issues or questions might this type of situation raise?</span></p>

<p><span style="font-size: 17px; ">Would it make any difference if the husband concealed bi-sexual and/or homosexual relationships from his wife and continued to have intimate relations with her without her knowledge?</span></p>

<p><font class="Apple-style-span" size="5"><span class="Apple-style-span" style="font-size: 17px;"><br /></span></font></p><p><span style="font-size: 17px; ">Might a RI Judge consider that the husband's conduct constitutes "misbehavior and/or conduct or wickedness repugnant to and in violation of the marital covenant" as set forth in Rhode Island General Laws 15-5-2(8)?</span></p>

<p><font class="Apple-style-span" size="5"><span class="Apple-style-span" style="font-size: 17px;"><br /></span></font></p><p><span style="font-size: 17px; ">However, let's change the hypothetical momentarily. &nbsp;What if the husband continued bi-sexual and/or homosexual relations while also engaging in intercourse with his wife and recklessly caused her to get infections, disease and/or AIDS/HIV? &nbsp;Might that affect a Rhode Island Judge's thought process on the subject? &nbsp;</span></p>

<p><font class="Apple-style-span" size="5"><span class="Apple-style-span" style="font-size: 17px;"><br /></span></font></p><p><span style="font-size: 17px; ">Let's twist our hypothetical marriage and divorce for a minute and arbitrarily consider a few questions.</span></p>

<p><font class="Apple-style-span" size="5"><span class="Apple-style-span" style="font-size: 17px;"><br /></span></font></p><p><span style="font-size: 17px; ">Would it be possible if the husband were only having relationships with men to reasonably argue that he had not cheated on his wife because he had not committed a sexual act with the opposite sex? &nbsp;Does RI law even say anything about this?</span></p>

<p><font class="Apple-style-span" size="5"><span class="Apple-style-span" style="font-size: 17px;"><br /></span></font></p><p><span style="font-size: 17px; ">If one were just to consider the wife's burden of proof before the court, might the husband's extramarital conduct with men be considered gross misbehavior or wickedness as stated in Section 8 of the statute?</span></p>

<p><font class="Apple-style-span" size="5"><span class="Apple-style-span" style="font-size: 17px;"><br /></span></font></p><p><span style="font-size: 17px; ">What affect if any might the fact that Massachusetts had approved same sex marriages for a time have on a Rhode Island Court's findings and rulings?</span></p>

<p><font class="Apple-style-span" size="5"><span class="Apple-style-span" style="font-size: 17px;"><br /></span></font></p><p><span style="font-size: 17px; ">What kind of conduct is considered "repugnant to the marriage covenant" under Rhode Island law?</span></p>

<p><font class="Apple-style-span" size="5"><span class="Apple-style-span" style="font-size: 17px;"><br /></span></font></p><p><span style="font-size: 17px; ">By the same token, what conduct would be considered "wickedness" as envisioned by the Rhode Island Statute?</span></p>

<p><font class="Apple-style-span" size="5"><span class="Apple-style-span" style="font-size: 17px;"><br /></span></font></p><p><span style="font-size: 17px; ">Under any of these hypothetical scenarios, might there be any conduct by the husband which causes his conduct to reach the level of "gross misbehavior" and/or "wickedness"?</span></p>

<p><font class="Apple-style-span" color="#0000BF" size="5"><span class="Apple-style-span" style="font-size: 17px;"><br /></span></font></p><p><span style="font-size: 17px; "><span style="color: #0000bf; ">Please keep in mind that this article is not an attack, nor even a criticism of a bi-sexual,&nbsp;homosexual or lesbian lifestyle. &nbsp;Rather, this is merely the application of a hypothetical with possible scenarios and questions that&nbsp;</span><span><span style="text-decoration: underline;color: #0000bf; ">may or may not</span><span style="color: #0000bf; ">&nbsp;affect these&nbsp;</span></span><span style="color: #0000bf; ">seldom used grounds for divorce under Rhode Island law. &nbsp;Specifically this is a preliminary consideration about whether actions under this hypothetical scenario and the various questions posed herein might fall within the divorce grounds provided by R.I. General Laws 15-5-2(8) as noted above.</span></span></p>

You will need to hire a lawyer to prepare this specialized Order. Typically, you will need to provide the lawyer with a certified copy of your Final Judgment of Divorce, any Marital Settlement Agreement you entered into with your spouse as well as other required information about your ex-husband's employer, etc...</font></font></font></span><span class="Apple-style-span" style="font-family: Arial, Helvetica, sans-serif; font-size: 14px; font-weight: normal; ">&nbsp;</span></b></span></font></div><div><font class="Apple-style-span" color="#000000" face="Arial, Helvetica, sans-serif"><br /></font></div><div><font class="Apple-style-span" color="#000000" size="6"><span class="Apple-style-span" style="font-size: 20px;"><b><span class="Apple-style-span" style="font-size: 14px; font-weight: normal; "><font class="Apple-style-span" style="font-size: 1.25em; ">The QDRO lawyer will typically contact the pension administrator's office to obtain all the terms and conditions relating to your ex-husband's pension account. Then, based upon those terms and conditions the QDRO lawyer will draft a QDRO which will need to be reviewed by your ex-husband's divorce lawyer and/or your ex-husband if your ex-husband was unrepresented. If the draft is approved by your ex-husband's lawyer or your ex-husband, then it is sent for the Pension Administrator's review.&nbsp;</font></span></b></span></font></div><div><font class="Apple-style-span" color="#000000" face="Arial, Helvetica, sans-serif"><br /></font></div><div><font class="Apple-style-span" color="#000000" size="6"><span class="Apple-style-span" style="font-size: 20px;"><b><span class="Apple-style-span" style="font-size: 14px; font-weight: normal; "><font class="Apple-style-span" style="font-size: 1.25em; ">Thereafter, if the QDRO is in compliance with the terms and conditions of the pension, then it will receive preliminary approval by the pension administrator who will notify your lawyer. After pension administrator approval is received, then your Rhode Island divorce attorney will need to go into family court (your divorce file may have to be re-opened) and the court must approve of and sign the QDRO. Thereafter, the clerk of the family court will enter the QDRO on the records of the family court after the judge has signed it.&nbsp;</font></span></b></span></font></div><div><font class="Apple-style-span" color="#000000" face="Arial, Helvetica, sans-serif"><br /></font></div><div><font class="Apple-style-span" color="#000000" size="6"><span class="Apple-style-span" style="font-size: 20px;"><b><span class="Apple-style-span" style="font-size: 14px; font-weight: normal; "><font class="Apple-style-span" style="font-size: 1.25em; ">Next, you or your Rhode Island divorce attorney must then provide a certified copy of the signed and entered QDRO to the pension administrator who will then follow the Order in accordance with the the QDRO's terms and you will receive whatever pension funds you are entitled to as set forth by the QDRO and in accordance with the terms and conditions of the pension.</font></span><span class="Apple-style-span" style="font-family: Arial, Helvetica, sans-serif; font-size: 14px; font-weight: normal; ">&nbsp;</span></b></span></font></div><div><font class="Apple-style-span" color="#000000" face="Arial, Helvetica, sans-serif"><br /></font></div><div><font class="Apple-style-span" color="#000000" size="6"><span class="Apple-style-span" style="font-size: 20px;"><b><span class="Apple-style-span" style="font-size: 14px; font-weight: normal; "><font class="Apple-style-span" style="font-size: 1.25em; ">Please note that this QDRO should have been done long ago. This process can take anywhere from three to eight (8) months so you should not expect to receive anything right away. I opted for joint custody but I have physical placement. She is supposed to spend every Tues and Sat overnight with him. He has become inconsistent with picking her up and sometimes doesn't. Also, he drops her off to spend Saturday overnights with his mother after I have repeatedly asked him to keep her when she is supposed to be with him. She spends pretty much every Sat overnight with his mother. Also, he is negligent in adequately taking care of her- he fails to bathe her, brush her hair, brush her teeth, dress her appropriately, etc. I am not looking to cut him out of her life but instead to limit the time she spends with him during the school week. (I am looking for maybe every other weekend?) I have kept very good documentation and am looking to see what my options are in changing the agreement we have without having to hire a lawyer. At this point in time, I can not afford to spend a lot of money on a lawyer but feel that I need to take some step for my daughter's benefit. Please let me know what options, if any, that I have.         <![CDATA[ <p><span style="font-size: 17px; ">A call from a lawyer colleague alerted me to the fact that Judge Laureen D'Ambra is being considered as one of the nominees for a position on our Rhode Island Supreme Court was enough to increase my concern for the people of our fair state.</span></p>

<p><span style="font-size: 17px; ">How many stories are there about Judge Laureen D'Ambra and the damage she caused to Rhode Island Families while she was assigned to the domestic calendarin Washington County for two (2) years on the Domestic Calendar?</span></p>

<p><span style="font-size: 17px; ">I know of six (6) families victimized by Judge D'Ambra's actions in the course of her duties as a Rhode Island Associate family court judge and I am convinced there are likely to be many more. 

Due to bronchitis I am not in a position to write nearly as much as I would like at this time about Judge Laureen D'Ambra and the damage I believe she would invariably cause the people of Rhode Island if she were appointed to the Rhode Island Supreme Court by Governor Carcieri, but after this posting I will get ample rest and begin anew in the morning.</span></p>

<p><span style="font-size: 17px; ">It is my understanding that public comment regarding the Nomination of Judge Laureen D'Ambra for the position of a seat on the Rhode Island Supreme Court will be taken on Tuesday evening. &nbsp;I am uncertain where or exactly when, but I intend to speak out in the very least in the form of a formally documented letter to the Nominating Committee as well as to Governor Carcieri as quickly as possible.</span></p>

<p><span style="font-size: 17px; ">As many of you may know or may have read, I fell victim to Judge D'Ambra in a divorce proceeding in July of 2007, and notwithstanding the "free pass" Judge D'Ambra was given on what were clear and definite violations of her judicial ethical canons, the evasion of any type of reprimand was not, in my humble opinion, due to any substantiated finding that Judge Laureen D'Ambra had not violated her judicial canons, but rather that her ability to escape any sort of punishment was by virtue of other considerations be they political, financial or otherwise in the form of "who she knows."</span></p>

<p><span style="font-size: 17px; ">Though I was not born and raised in Rhode Island, it has come to be my home and most likely will be such until the day I die. &nbsp;Yet there are some travesties that I cannot remain silent on no matter what pressures the powers may be may bring to bear upon me or the threat that I will lose my license to practice law which is my livelihood. I am in no uncertain terms convinced that the appointment of Judge Laureen D'Ambra to a seat on our highest Court is not something I can sit by and allow to happen without some sort of action and call to action for others.</span></p>

<p><span style="font-size: 17px; ">If you have been wronged by Judge Laureen D'Ambra and you have felt that you have had no redress and no way of expressing or righting the injustice done to you, I invite you to be present on Tuesday evening to voice your dissatisfaction with Judge Laureen D'Ambra's nomination and consideration for a seat on our state's highest court.</span></p>

<p><span style="font-size: 17px; ">I know of six cases that I have personally investigated that were unwarranted purely due to Judge D'Ambra's own unknown personal agenda and/or her lack of knowledge or even fundamental due process of law while she was appointed to on the Washington County Family Court's Domestic Relations Calendar in 2006 and 2007. &nbsp;</span></p>

<p><span style="font-size: 17px; ">I urge those who have been wronged by Judge D'Ambra, both citizens and lawyers, to come forward and post to this website, call me, contact Governor Carcieri and do what is necessary and prudent to show your lack of confidence for Judge Laureen D'Ambra's holding a seat in our highest court.</span></p>

<p><span style="font-size: 17px; ">If Judge Laureen D'Ambra was lax and caused damage to citizens of our state and counsel who appeared before her in the family court shortly after she was appointed to the family court's domestic relations calendar in Washington County Family Court, what damage and havoc might be done to our state with this woman as a Rhode Island Supreme Court Justice. The thought is almost unfathomable.</span></p>

<p><span style="font-size: 17px; ">I, for one, cannot stand idly by and say nothing based upon what I know about her conduct in recent years. &nbsp;In my humble opinion her conduct does not speak well of our state, has placed our family court in a bad light before the citizens of this state and cannot and should not be tolerated.&nbsp;</span></p>

<p><span style="font-size: 17px; ">Comment here. &nbsp;Tell your story. &nbsp;Express your views and make a difference. &nbsp;Having seen the operation of our court system for the better part of 20 years now, I have seen a need for improvement such that our image is not labeled by the nation as the most corrupt state in the United States. &nbsp; &nbsp;I do not believe our state would regress by the appointment of Judge Laureen D'Ambra to our highest court. &nbsp;The time to speak is now. &nbsp;Write. &nbsp;Call. &nbsp;Send a letter to Governor Carcieri, but do not put this off. &nbsp;There is no time to waste. &nbsp;The committee and the Governor need your direction in the very least away from a candidate that is likely to injure our state and our citizens. &nbsp;Tomorrow begins another day and a reminder of why I am so strongly against Judge Laureen D'Ambra's consideration in this regard.</span></p>

        <![CDATA[<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial"></p><p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial">Many things can prevent a Rhode Island Divorce Case from settling.&nbsp; In fact, while I cannot speak for all attorneys in other states I tend to believe that people and attorneys do not differ that much from state to state.&nbsp; With that in mind, these may be the top two things that prevent divorces from settling on a national basis.</p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial; min-height: 14.0px"><br /></p>
<span style="font-size: 18px; "><span style="color: #c00000; font-size: 18px; ">* * * The 2nd Greatest Thing that Prevents Divorce Settlements * * *</span></span><p></p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial; min-height: 14.0px"><br /></p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial">In my Rhode Island divorce practice, experience has taught me that "anger" is the second greatest contributor to the inability of parties, with or without attorneys, to reach a reasonable settlement in a divorce.</p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial; min-height: 14.0px"><br /></p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial">While divorce often evokes a plethora of emotions in one or both parties in a marriage, none seem as prominent or as powerful to delay and prolong the resolution of the divorce as "anger."&nbsp; The anger may stem from any number of things ranging from a suddenly discovered long-term affair to a drug or gambling addiction and more. &nbsp; As a divorce attorney I leave the treatment of a parties' anger to psychologists and therapists better equipped to address and treat its source and help divorcing parties deal with their mental and emotional dilemmas.</p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial; min-height: 14.0px"><br /></p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial">However, there is no doubt that as a divorce lawyer, I (and my colleagues) deal with the effects that the anger of either party has on the divorce proceeding.&nbsp; These effects range from emotion filled meetings with angry clients who feel cheated and betrayed by their spouse to the vindictive decisions or actions of an opposing spouse with an outright desire to injure the other spouse emotionally or even physically. &nbsp;</p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial; min-height: 14.0px"><br /></p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial">Divorce settlements are often prevented by the anger of one spouse at the other spouse.&nbsp; Usually this takes the form of one or both spouses making demands in the settlement of their marriage that in some way justify the party's feelings or otherwise vindicate the spouse in some way by gaining more in the way of an apportionment of assets or less in the way of an assignment of marital debt.&nbsp; Simply put this becomes a matter of getting something that makes the spouse feel that he or she "won" in some way over the other spouse.</p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial; min-height: 14.0px"><br /></p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial">In truth, there are no real winners in such a situation.&nbsp; The anger merely costs the parties more physical, mental and emotional turmoil than is necessary and the attorneys make more money while the parties have less money in the end for their own needs. &nbsp;</p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial; min-height: 14.0px"><br /></p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial">Even if one party views the divorce trial or settlement as a "win", it is merely an illusion.&nbsp; No one wins in a divorce.&nbsp; The only way to truly win is to resolve the issues you have at present and move on to a new and different future without the other person as your spouse.</p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial; min-height: 14.0px"><br /></p><p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial; min-height: 14.0px"><br /></p><a name="RIDivorceSettlements"></a>

<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial">Though there are many who may disagree with my conclusion that "making the wrong choice of divorce lawyer" is certainly not the greatest thing that prevents divorce settlements, I leave those persons to their opinion and remain steadfast in my belief that divorce lawyers are often the greatest impediment to preventing divorce settlements.</p>

<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial">Having practiced almost exclusively as a Rhode Island divorce and family law attorney for nearly a decade I have had the opportunity to oppose countless attorneys who have represented the opposing spouse.&nbsp; From the outset of my practice I noted a distinct pattern and made it a practice to listen more than I spoke, it is this practice and skill that has served me best in my divorce and family law practice. &nbsp;</p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial; min-height: 14.0px"><br /></p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial">I have gained my most valuable knowledge by listening to divorce attorneys I have opposed in court as well as listening to others while walking through the halls of the family courts or waiting to be heard in the courtrooms.</p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial; min-height: 14.0px"><br /></p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial">Some Rhode Island divorce lawyers, though certainly not all, do not share my "families first" philosophy.&nbsp; Clients should keep in mind that there are those attorneys who see clients merely as a paycheck.&nbsp; If you were a divorce attorney with heavy personal financial burdens or with a substantial desire for increased monetary rewards and you knew that your income was dependent upon the number of clients who hire you each year and how much you earn from those clients, what might you do?</p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial; min-height: 14.0px"><br /></p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial">Consider each of these questions and answer them for yourself.</p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial; min-height: 14.0px"><br /></p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial">If your divorce case lasts longer, couldn't a divorce attorney justify earning more from your case?</p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial; min-height: 14.0px"><br /></p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial">If you are upset about your divorce, couldn't a Rhode Island divorce attorney aggravate what is upsetting you in order to make it more difficult and take longer to set up your case?</p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial; min-height: 14.0px"><br /></p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial">If your divorce attorney knows that to make his or her desired income he or she must represent X number of divorce clients each year and make $5,000 on each client, is it more likely or less likely that your divorce attorney will counsel you to agree to a reasonable settlement of your case within the first three weeks of your case?</p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial; min-height: 14.0px"><br /></p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial">You may draw your own conclusions.&nbsp; For my part, virtually every case that I have been unable to reasonably settle within a reasonable period of time before both my client and the opposing spouse are injured by the financial burdens associated with divorce litigation have been prevented by attorneys who have placed their own interests before that of their clients.&nbsp; Some of those attorneys even have an underhanded pattern of doing so such that I now warn my clients of what we are up against before we proceed further.&nbsp; Attorneys who act in this way do a disservice to the legal profession and an even greater disservice to their own client.</p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial; min-height: 14.0px"><br /></p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial">Rhode Island divorce attorneys who act in this way are a greater prevention to the settlement of divorce cases because emotion is not intentional and can be countered by the reasonableness of a good divorce lawyer who cares about the client and places the client's interests first.&nbsp; However, the intentional actions of a lawyer with his or her own interests placed before those of the client in every sense (mentally, emotionally, physically or financially), can sometimes not be prevented even by the most skilled opposing practitioner.</p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial; min-height: 14.0px"><br /></p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial">Ultimately, if you have significant anger regarding your divorce, it is always advisable to seek the assistance of a counselor even if you do not believe your anger is affecting your judgment.&nbsp; Often, anger does, in fact, affect judgment in divorce cases to a person's detriment. &nbsp;</p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial; min-height: 14.0px"><br /></p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial">Additionally, be aware of what your attorney is doing in your case and remain active in your communications with your attorney.&nbsp; Most cases are capable of being resolved within three (3) months if the parties and attorneys act in a reasonable manner.&nbsp; If it takes longer than this, speak with your attorney, speak with your spouse and if necessary, speak with your individual counselor.&nbsp; You may discover that what you think is happening in your divorce case as represented by your attorney is much different than what is actually occurring.</p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial; min-height: 14.0px"><br /></p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 17.0px Arial">In any divorce, be aware of your emotional state and be aware of your case and your divorce attorney's conduct.&nbsp; In the end, both will serve you well in resolving your Rhode Island divorce case.</p>

However, both words are terms of art in Rhode Island Divorce and Family Law.&nbsp;</span><em><span style="font-size: 17px; ">Placement</span></em><span style="font-size: 17px; ">&nbsp;is the legal right of a parent to have&nbsp;</span><em><span style="font-size: 17px; ">primary physical possession</span></em><span style="font-size: 17px; ">&nbsp;of one or more minor children for a particular time.</span></p>

<p><span style="background-color: #ffff00; "><span style="font-size: 17px; ">Note: &nbsp;Both in its court usage and in Rhode Island Domestic Relations caselaw "placement" is sometimes referred to as "physical custody".</span></span></p>

<p><span style="font-size: 17px; ">Unless the Department of Children, Youth and Families is involved, there are typically only two placement scenarios. Placement is either solely with one parent or placement is shared between both parents. Joint physical placement of minor children is typically only awarded by the court if the family court judge reasonably believes that such an arrangement is workable and is in the best interests of the minor child(ren).</span></p>

<p><span style="font-size: 17px; ">Placement of the minor children is often by agreement of the parties and approved by the court absent extenuating circumstances where the court may find the arrangement is not in the best interests of the children.</span></p>

<p><span style="font-size: 17px; ">Changes in placement can be made if one of the parties files a Motion for Change of Placement or may be made by the court (</span><em><span style="font-size: 17px; ">sua sponte - at the court's own discretion</span></em><span style="font-size: 17px; ">) if the Rhode Island family court judge believes that the best interests of the minor child(ren) would be served by such a change.</span></p>

<p><span style="font-size: 17px; ">Rhode Island law and Rhode Island Divorce/Family Court judges view the well-being of the minor child(ren) as a paramount concern in domestic relations situations and judges will often take protective measures or issue Orders to protect with the well-being of the minor child(ren).&nbsp;</span></p>

<p><span style="font-size: 17px; ">A request for the change of an established placement routine for one or more child(ren) that is agreed upon by the parents themselves, either by a Consent Order, Judgment, or Marital Settlement Agreement in an uncontested divorce or at a Nominal Divorce hearing is sometimes granted by the court if the changed situation is, in fact, one that will work for the child(ren), has worked successfully for a period of time prior to the request, and can reasonably seen to serve the child(ren)'s best interests.</span></p>

<p><a name="Coventry-RI-Child-Custody-Lawyers"></a><span style="font-size: 17px; ">However, your request for a change in child placement may be (and often is) scrutinized by the Rhode Island Family Court if there isn't a substantial change in circumstances to warrant the change, or if the reason does not sufficiently demonstrate to the court that the change of placement is in the best interests of the child(ren).</span></p>

<p><span style="font-size: 17px; ">Cases involving a contested requests for changes in placement may occur when one spouse that has placement of the child(ren) exhibits behavior that is dangerous or otherwise detrimental to the child(ren). In these cases the court will endeavor to assist the parties to try to reach a resolution that </span><em><span style="font-size: 17px; ">is </span></em><span style="font-size: 17px; ">in the best interests of the minor child(ren) and preserves as much family harmony as possible for the children and between the parents.</span></p>

<p><span style="font-size: 17px; ">Rhode Island family court judges have also ordered a change of placement where the placement parent is resorting to criminal behavior or consorting with those who are engaged in such behavior. Other reasons for ordering a change of placement include alcoholism, drug use, physical abuse, sexual abuse, mental cruelty, a parent's inability or unwillingness to provide for the fundamental needs of the child(ren) or a parent's attempt to remove the children from the state without permission of the court.</span></p>

<p><span style="font-size: 17px; ">It is important to know what you need to do to protect your child and to take the necessary steps not simply at this moment but for the future as well.</span></p>

<p><span style="font-size: 17px; ">It is additionally important to know who is entitled to the tax deductions for the minor children, whether this can be modified by agreement of the parties, and what is required by the Internal Revenue Service and Rhode Island Division of Taxation in order to be able to lawfully take deductions for the minor child whether you are the placement or non-placement parent.</span></p>
